Consumer Terms & Conditions of Sale
These terms and conditions apply to all wines, spirits or other goods or services supplied by Ditton Wine & Spirits, the trading name of Ditton Wine Traders Ltd ("we" or "us"), to you ("the Customer" or "you"), including through our website. By placing an order with us you agree to these Terms and Conditions.
This is a retail website; we do not facilitate online sales to the trade. If you are a trade customer, separate Trade Terms apply — please contact us at info@dittonwineandspirits.com to place an order.
Ordering and Confirmations
You must be at least 18 years old to place an order with us. If you live somewhere the legal drinking age is higher than 18, you must meet the higher age requirement that applies where you live.
Placing an order does not by itself form a contract. When you place an order, your payment is authorised and taken, and we send you an email confirming your order. The contract between you and us is formed when we send that confirmation and accept your order, at which point it becomes binding.
Some orders can't be completed online — for example, where a product is temporarily unavailable, or we're unable to ship to your destination. If that happens, please get in touch; we may be able to arrange the sale directly. For security, especially on high-value orders, we may ask to complete your purchase with you directly rather than through online checkout — please contact us and we'll help.
We reserve the right not to accept any order, at any point up until the goods are dispatched, without giving a reason. If we can't accept your order, we'll tell you and won't charge you.
We take great care to ensure everything advertised is available, but due to the scarcity of many of our products we may occasionally go out of stock. All goods are offered subject to availability at the time we pick your order. If a product becomes unavailable after you order, we'll contact you to arrange a replacement or another solution, at our discretion.
Pricing and Duty/VAT
All prices on this site are in British Pound Sterling (£) and are shown duty-paid — inclusive of UK excise duty and VAT — unless stated otherwise.
Many of our products can also be supplied under bond (excluding UK excise duty and VAT) — for example for in-bond storage, or delivery to a UK bonded warehouse. If you would like to purchase or take delivery under bond, please contact us at info@dittonwineandspirits.com and we'll arrange it. More detail is on our Delivery & Storage page.
For deliveries outside the UK, the duty and VAT treatment depends on the destination and is confirmed with you before your order is completed. Any import duties, tariffs or taxes charged when your products arrive in the destination country are your responsibility; your local customs office can advise, and we're happy to help guide you. As the purchaser, it's your responsibility to ensure your purchase complies with the laws of the country it's imported into. Products may be inspected on arrival at port, and we can't guarantee packaging will be free of signs of inspection.
Although we work hard to keep pricing accurate, errors occasionally happen. If we find a pricing error, we'll either contact you to ask whether you want to continue at the correct price or cancel, or cancel the order and tell you. We're not obliged to supply goods at an incorrect price.
Payment
Payment is processed securely through Shopify. We accept major credit and debit cards (Visa, Mastercard, American Express) and any additional methods shown at checkout, such as Shop Pay, Apple Pay, Google Pay and PayPal. We only accept payment in British Pound Sterling (£), without surcharge. For certain high-value or off-site orders, payment by bank transfer can be arranged — please get in touch.
Whether a card payment succeeds is a decision made by your bank; if there's an issue, please contact them to resolve it. We always run security checks on cards to protect you and us against fraud, and may ask for additional information. We reserve the right to refuse an order and refund you even if payment has been taken. Use of stolen cards is reported to police in all cases. We may withhold products for non-payment of any invoice, and may refuse to release products until your order is paid in full.
Ownership
We retain title to all goods until all sums due from you for any order are paid in full (in cleared funds), including for other goods we've supplied where payment is due. You take title and risk from the point we deliver the goods to the address you gave us.
Delivery
We use independent couriers and charge delivery at cost. Full delivery details and rates are on our Delivery & Storage page. If courier rates change significantly and suddenly between your order and shipment (beyond our control), we'll contact you to offer cancellation or an alternative.
All delivery dates and times are estimates. We'll aim to deliver within the estimated time and, in any case, within a reasonable period. If we're prevented from delivering on time by events outside our reasonable control, the "Delays outside our control" section applies.
Our couriers attempt delivery twice; after that, items may be returned to us if you don't respond to their communications. If items are returned because of an incorrect or incomplete address you gave us, we may pass on the cost of redelivery. Couriers may require photo ID or a signature to verify you are of legal drinking age. Customs departments (especially in the USA) sometimes hold parcels for inspection, which is out of our control and may add time.
Exclusions
Products bought through this website are sold for personal use, not for resale — we don't facilitate reselling. If you buy products intending to resell them, it is your sole responsibility to verify trademark-rights exhaustion in your market(s), including the European Economic Area (EEA), and to comply with all applicable laws and regulations, including keeping the customs status (T1/T2) we sold them with. You agree to compensate Ditton Wine Traders Ltd for any costs arising from a loss of T1 customs status, including any duty, levy, tax, penalty or interest becoming due.
Inspection and Acceptance
Please inspect all products on delivery. If you notice a fault or problem, tell us right away; we may ask for photographs of any faults or quality issues.
Warranty and Quality Control
As taste and drinkability are subjective, we can't guarantee them. For older or high-value products we make reasonable efforts to verify provenance, but we can't guarantee the authenticity or quality of the liquid in the bottle; opinions vary and definitive authentication is not always possible even after testing. Given the nature of the wines we sell, we don't provide refunds for corked wines. Older items may show imperfections (marks on bottles, minor label tears, marks/dents on boxes and tubes); by purchasing you accept products may show defects and wear consistent with their age, provenance and nature, or any condition we've notified you of. We can provide high-resolution images of most products — please ask before purchase if in doubt. Any provenance information passed on from our supplier is not something we can independently research, test or verify, and we don't warrant it. We don't accept liability for minor or inconsequential imperfections.
Delays outside our control
If supply is delayed by an event outside our reasonable control (e.g. strike, industrial action, riot, terrorist attack, war, severe weather), we'll contact you as soon as possible and do what we can to reduce the delay. Provided we do this, we won't compensate you for the delay; but if it's likely to be substantial, you can contact us to end the contract and receive a refund for products paid for in advance but not received, minus any reasonable costs we've already incurred.
Liability
We're responsible for losses you suffer caused by us breaking this contract, unless the loss was: unforeseeable; caused by a delaying event outside our control (where we've taken the steps above); avoidable by your taking reasonable action; or a business loss relating to your trade, business, craft or profession.
Errors and Omissions
Errors may occasionally occur (technical or human). If there's an obvious error in a price, we'll tell you as soon as possible and let you reconfirm at the correct price or cancel. If we can't reach you, you agree we may treat the order as cancelled without liability.
Cancellation and Returns
You have the right to cancel and return orders — full details are in our Refund policy. In short, you have 14 days from receipt to cancel; to do so, email info@dittonwineandspirits.com with your order details, or call +44 20 8339 9112.
Crime prevention
For the prevention or detection of offences and the apprehension or prosecution of offenders, we may share information we collect with the Police and other public or private bodies in accordance with relevant legislation.
General / Assignment / Third parties / Enforcement / Law
If any provision is held invalid or unenforceable, the rest continues to apply. We may transfer our contract with you to another organisation; we'll tell you in writing and ensure it doesn't affect your rights. Nobody other than you and us has rights under this contract. A delay in enforcing this contract doesn't prevent us enforcing it later. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
Consumer Terms & Conditions of Storage
These terms apply to any storage or similar services provided by us, Ditton Wine Traders Ltd ("we" or "us"), to you, the Customer ("you"). We won't be bound by any other terms you seek to impose. These apply to retail consumers only; trade customers have separate Trade Terms.
Instructions
You may instruct us to store your products by: selecting in-bond storage with Ditton at checkout when ordering via our website; instructing us at the time of an off-site purchase (e.g. by phone or email); or, for goods not purchased from us, by written instruction to info@dittonwineandspirits.com confirming the products to be stored (we may ask for more information first; acceptance of goods not purchased from us is at our discretion). The storage contract is formed only when we accept your instructions and all duty and VAT on the products has been paid and, where necessary, received by us — at which point we send a confirmation email. Once accepted, your instructions continue until you cancel or amend them.
Placing your wines and whiskies into storage
For goods not purchased from us: we can only accept goods where an instruction has been received and the goods arrive with valid, appropriate delivery documentation, failing which we may return them. Unless we've agreed to arrange collection, you're responsible for sending goods to us, and we may apply a receiving charge. We do not inspect goods sent for storage and take no steps to verify their authenticity, provenance, quality or condition.
For goods purchased from us: if we've agreed to store them, we'll arrange for them to be delivered to and placed in our storage facility.
Ownership and insurance
You warrant you are the lawful owner of the goods stored. Your goods are held by our nominated warehouse keeper under our exclusive instructions, in a sub-account in your own name, to identify them as your property. Title remains with you, subject to our rights under "Default" below. We arrange insurance for stored goods at the lower of replacement or purchase price plus 10%, provided by a third-party insurer subject to exclusions and limitations (a copy of which we'll supply on request). We're not liable for the replacement cost of goods where loss or damage isn't covered by our insurance. In particular, the insurance won't cover: depreciation; damage from inherent defects, wear and tear, gradual deterioration, or the action of light or atmospheric/climatic conditions occurring before storage with us; losses from a defect in your title or a previous/future owner's; damage amounting to lost profit or indirect/consequential loss; damage from your wilful misconduct, dishonesty or deliberate act/omission; and damage from events outside our control (radioactivity, terrorism, aircraft pressure waves, war and civil commotion, strikes, riots and similar risks).
How we store wine and spirits
We'll use reasonable skill and care. Our storage facility is owned and operated by a third party: London City Bond, Dinton Woods Storage Facility, Catherine Ford Road, Dinton, Salisbury SP3 5HB.
Removing your wine and spirits from storage
You can collect goods on at least 72 hours' prior written notice. All fees and charges must be settled in full before removal. Where goods are held in-bond, you may need to pay duty and VAT to remove them. We may, as your agent, arrange delivery, in which case you're responsible for all delivery costs, provided we've given you reasonable notice of the cost. We'll use reasonable endeavours to fulfil delivery/collection instructions but can't accept liability for collection or deliveries. We may charge for re-deliveries needed because of your absence on the agreed date. It's a criminal offence to deliver alcohol to anyone under 18; we may refuse to deliver where we or our courier believe the recipient is under 18. You must check that goods delivered match your instructions and notify us of any errors, discrepancies or deficiencies within 7 days of receipt.
Fees, charges, and payment terms
Our storage fees and charges are listed on our website. We invoice annually after the year ends; invoices are payable in full within 30 days. Disputes about an invoice must be raised within 7 days of receipt by emailing info@dittonwineandspirits.com. Rates are subject to annual review, and we'll notify you of changes at least 30 days before the billing year begins; if charges are due to rise and you no longer wish to store with us, you'll need to remove your goods before 31 December of the current billing year to avoid the increase. Storage charges start on the date we agree to store your goods (or, if we've agreed a fee-free period, when that period expires), and are calculated pro rata if storage begins or ends part-way through the year. You must cover any unpaid storage before removing goods; if we haven't yet invoiced for a period, we may invoice when you ask to remove goods, immediately due, and may refuse release pending cleared funds. We may charge interest on overdue sums at 4% above the Bank of England base rate from the due date.
Default
If you owe us any amount (storage, purchase or otherwise) overdue by 30 days or more, you agree we may purchase any of your goods held by us, at a price governed by these terms, in satisfaction of your liabilities. We'll first send written notice to your last known invoice address of our intention to purchase; if the unpaid amount isn't paid within 30 days of that notice, we may take ownership and possession and, at our discretion, dispose of some or all of your goods. On purchase, we'll credit you the market value (reasonably assessed from our list prices or reasonable enquiries, on the date seven days after the notice), set off against sums you owe (including interest and reasonable costs of purchasing), and account to you for any excess (without interest). After crediting you, we hold title and may dispose of the goods freely. This right doesn't affect our other remedies, and you remain liable for any shortfall, with interest continuing to accrue at 4% above base rate.
Claims and Liability / Crime prevention / General / Assignment / Third parties / Enforcement / Law
We're responsible for losses caused by us breaking this contract unless the loss was unforeseeable, or caused by an event outside our control (including failure of our designated keeper or facility outside our control, strikes, lockouts or industrial action). We may share information with the Police and other bodies for crime prevention/detection as above. The General, Assignment, Third parties, Enforcement and Law provisions are the same as in the Terms of Sale above, and these terms are governed by the laws of England and Wales with the exclusive jurisdiction of its courts.
